David Frankel from USTelecom is abusing authority given by the FCC, by leading a charge to get us shut down using fear and intimidation tactics to do so.
David Frankel (phone number 408-884-1445) is a member of USTelecom’s “Industry Traceback Group” (ITG). The ITG’s SOLE purpose is to stop illegal robocalling. However, we also have a similar interest in stopping such and are apparently viewed as a threat to their operation.
The FCC has instituted very specific guidelines as to how ITG is to deal with illegal robocalling in USTELECOM’S INDUSTRY TRACEBACK GROUP Policies and Procedures and these procedures are being violated.
USTelecom’s Traceback Group even violates it’s own “Policies and Procedures“, as we will explain in due time.
For example, if ITG has concerns, these concerns are to be addressed IN WRITING to the appropriate telecom involved in passing the suspected illegal traffic, using a very specific form and wording to approach the matter in a professional manner. Instead, ITG has decided to abuse the authority awarded to them by the FCC by going after my providers with targeted harassment for 6 months now in an effort to get our operation dismantled. Whether they succeed or to is yet to be seen, but they most definitely have the power to do so.
If this abusive overreach of their power does not stop, we WILL be filing a complaint with the FCC and furnish a mountain of evidence of our claims. If necessary, we will form a class-action suit against the FCC to have the FCC revoke their contract with USTelecom.
Other legitimate agencies are also targeted with similar fear and intimidation tactics, establishing a clear pattern of abuse of authority. Because of this, we are building our own consortium joint effort to stop this pattern of abusive overreach. These agencies and other telecoms have expressed interest in joining us in this likely class-action lawsuit.
Help us fight scam and illegal robocallers by reporting the details to us. Unlike USTelecom, which shuts down about 200 robocallers per month, we successfully shut down 200 robocallers AND scammers (combined) per day. Clearly we are viewed as a threat to their operation and they want me gone!
A few noteworthy side-points:
USTelecom supposedly operates at the address of 601 New Jersey Ave, NW Suite 600, Washington, DC 20001. We are investigating this to see if this is actually accurate.
David Frankel easily side-steps scrutiny by USTelecom by harassing other telecoms from a zipdx.com email account, which is in no way affiliated with USTelecom or the Traceback Group. Using a personal email account to harass and intimidate telecoms is NOT what the FCC has specified ITG to do.
We have audio recordings of David Frankel screaming and yelling. This very angry and non professional behavior is not likely what the FCC had in mind when giving ITG the power they have.
